These terms and conditions are binding and enforceable against all persons that access the Ikigai Reformer Pilates website or any part thereof in terms of section 11(3) of the Electronic Communications and Transactions Act 25 of 2002. (“ECT Act”)

If you do not agree to these Terms and Conditions, you must leave the Ikigai Reformer Pilates website now, as further use will automatically bind you to these terms and conditions.

We reserve the right to change, update or reissue these Terms and Conditions at any time. Any such changes will be posted to our website and you agree to be bound by such changes.

DEFINITIONS

  1. References to “we”, “us”, and/or “our” in these Terms and Conditions is a reference to Ikigai Reformer Pilates and its’ related affiliates.
  2. Ikigai Reformer Pilates website means the Ikigai Reformer Pilates site located at www.ikigaipilates.co.za and includes any part or element thereof.
  3. “User” means any person who enters and uses the Ikigai Reformer Pilates website, notwithstanding the fact that such a person only visited the home page of the website.
  4. References herein to the singular includes the plural and vice versa.
  5. Notwithstanding the fact that hyperlinks in these terms and conditions to copyright notices and legislation should be deemed part of these terms and conditions in terms of section 11 of the ECT Act, the fact that some or all of the hyperlinks may be non-operational, shall not play a role in determination of the validity and interpretation of these terms and conditions.

1. General

Ikigai Reformer Pilates was established in 2024 as a Reformer Pilates Studio and currently operates within the Republic of South Africa.

2. Allowed Use & License

Ikigai Reformer Pilates licenses the User to view, download and print the content of their website, provided that such content is used for personal, educational and/or non-commercial purposes only.

Content from the Ikigai Reformer Pilates website shall not be used or exploited by Users for any commercial and non-private purposes without prior written consent from Ikigai Reformer Pilates.

Users may only access and use the website for legal purposes.

Ikigai Reformer Pilates reserves the right to claim damages from the User if the User’s wrongful actions cause loss to the studio and may also instituted civil or criminal proceedings against the User for unlawful conduct involving this website.

Ikigai Reformer Pilates shall not be held liable, in any manner whatsoever, for any damage, loss or liability that results from the use of such content by the User or any third-party who obtained any content from the User.

3. Disclosures Required by Section 43 of the ECT Act

Access to the services, content, software and content downloads available from the Ikigai Reformer Pilates website is classified as “Electronic Transactions” in terms of the ECT Act and therefore, Users have the rights detailed in Chapter 7 of the ECT Act and Ikigai Reformer Pilates has the duty to disclose the following information:

Shall be referred to the arbitration in terms of the expedited rules of the Arbitration Foundation of South Africa and such arbitration proceedings shall be conducted in Johannesburg in English. The arbitration ruling shall be final and the unsuccessful party shall pay the costs of the successful party on a scale as between attorney and own client. 4. Removal and Correction of Content

Ikigai Reformer Pilates encourages users to report untrue, inaccurate, defamatory, illegal, infringing and/or harmful content available from the Ikigai Reformer Pilates website to us and we undertake to correct and/or remove such content or any part thereof, if the person reporting such content provided reasonable grounds to prove the alleged nature of the content.

5. Medical Warning

Prior to undertaking any new form of exercise, you should consult with your doctor or healthcare practitioner to ensure that you are mindful of your current health and any restrictions that may be appropriate for you.

When participating in our classes, do not over exert yourself and work at your own pace. Stop immediately if you feel pain or discomfort. You should immediately seek medical attention if there are any unanticipated changes to your physical condition at any time.

The onus lies on you to inform your instructor if you have any pre-existing injuries or medical conditions which may impact upon your ability to perform the exercises in our classes.

By undertaking any exercise class (including the use of any equipment purchased by us), you acknowledge that you do so at your own risk. The creators, producers, instructors and distributors of our exercise programs (together with their servants and agents) will not be held liable for any personal injury, loss or liability of whatsoever nature arising as a result of, or in connection with, your undertaking of any such exercise program or following advice contained on our website or given by our instructors.

Each new member will be required to complete a health questionnaire declaring that they are fit for training and if required, have received clearance from their doctor or other healthcare practitioner to engage in the physical activities as set out by our studio and instructors.

6. Prices and Bookings

Our current prices and timetables are displayed on our website. From time to time, our prices may change and these will be notified on the website.

To sign up to participate in our classes, you must create an account with us. Your account will be governed by these terms and conditions, our website terms of use and our Privacy Policy.

There are a set number of spaces in each class. To attend a class, you must reserve a space. Bookings can be made online, via our website or by calling, emailing or sending a WhatsApp to our Studio.

7. Referral Credit

From time to time, we may offer studio credit to our existing members for introducing a new member to our studio, during such time, Ikigai Reformer Pilates undertakes to inform our members of such a promotion. Studio credit may be used towards purchasing classes and is not redeemable for cash or any other form of payment.

8. Class Schedules

Class schedules are available on the website and are subject to change or be cancelled. Our studio will provide sufficient notice to members who may be affected by such change or cancellation.

9. Conditions of Entry

Ikigai Reformer Pilates reserves the right to refuse entry to, or eject from our studio, clients or others who are behaving in an anti-social, intoxicated, disorderly, aggressive, offensive or dangerous manner or in any manner which may threaten the security of our clients, employees or other people at the Studio.

In order to minimise disruption during classes held at our studio, we recommend that you aim to arrive at least 5 minutes prior to the scheduled commencement time of a class.

Clients are strongly discouraged from departing classes prior to their scheduled conclusion time as it is disruptive to the enjoyment of other members attending those classes.

Smoking is prohibited inside and at the front of our studios at all times.

You are required to treat all persons and property at the studio with all due care and respect.

10. Personal Safety and Acceptance of Risk

By attending any class at our studio and participating in reformer Pilates classes which involve the use of a Reformer machine, you will be performing physical activity and exercise which has an inherent risk of personal injury. Participating in Pilates is undertaken at your own risk.

You must inform instructors if there are any risks to your health by participating in Pilates, such as, but not limited to the following:

Pre-existing injury, illness, muscle soreness/discomfort or pregnancy.

Participating in any form of exercise at our studios with a Medical Condition is done entirely at your own risk. You acknowledge that you participating in any form or exercise at our studios may involve risks, including risk of personal injury.

Ikigai Reformer Pilates instructors are not medical practitioners, each instructor holds a valid CPR Certificate, however our instructors are not qualified to assess whether clients are in good physical condition and/or that clients can engage in exercise without detriment to their health, safety, comfort or physical condition. Clients are advised to seek medical advice prior to commencing any exercise program if they are in doubt of their ability to engage in exercise.

You acknowledge that our instructors may use tactile cueing and adjustment methods or make physical contact with you for correction purposes in order to ensure that Pilates practice is undertaken in accordance with Ikigai Reformer Pilates best practice.

11. Pregnancy

While Reformer Pilates can be safe during pregnancy, it is highly recommended to practice moderation and take special care when using the machine. Pregnancy women should be conscious of their body movements and avoid increasing resistance beyond what they were used to before pregnancy. It is crucial to prioritise safety and make necessary modifications to accommodate the changes in the body during pregnancy.

If you have a history of high-risk pregnancy or complications, we recommend that you consult with your doctor or medical practitioner to obtain the go-ahead prior to engaging in any of our classes.

12. Security

Ikigai Reformer Pilates is not responsible in any way for the safekeeping of your personal belongings that you bring into our studio. As such, we strongly recommend that you:

  1. Refrain from bringing any valuable personal belongings to our studio, such as mobile phones, jewellery, personal devices, wallets, bags and purses;
  2. Bring only any personal belongings into our studio which are absolutely necessary for you to possess for the duration of your visit.

13. Misuse of Bookings

We reserve the right, in our discretion, to suspend or terminate your use of our studio if we suspect any fraud or mises of our booking system.

14. Payment

It is your responsibility to ensure that there are sufficient funds available in your nominated bank account or credit card to cover the cost of booking classes on our platform.

If a payment is declined for any reason, we reserve the right to process payment anytime where sufficient funds are available in the nominated bank account or credit card in order to settle any fees that are owed. If an auto-debit is declined due to insufficient funds, our payment provider will charge for any failed transactions. This fee will be passed on to you approximately 7 days after the failed payment.

We are in no way responsible for additional fees that you may incur from your bank in relation to processing payment of classes.

15. Personal Information

Your personal information collected by us in accordance with these Terms and Conditions will at all times be dealt with in accordance with our Privacy Policy, a copy of which can be viewed in full on our website.

16. Limitation of Liability

Except for any liability that cannot be excluded by law, Ikigai Reformer Pilates (including its officers, employees and agents) excludes all liability, for any personal injury, loss or damage (including but not limited to loss of opportunity, loss of reputation or goodwill, loss of privacy or loss of corruption of information or data); whether direct, indirect, special or consequential, arising in any way out of your attendance at our classes. This includes but is not limited to theft, unauthorised access, or third-party interference
